CRIMINALIDADE E DIREITO: DIÁLOGO ENTRE A EVOLUÇÃO DO SISTEMA PUNITIVO E A MENTALIDADE SOCIAL.

O jogo é entendido enquanto um fenômeno complexo, em que a ação do jogador se caracteriza pela eticidade, uma vez que, além de expressar sua subjetividade, visa à boa vida (no caso do jogo, o prazer e a vitória). Assim, o caráter ético da ação do jogador se constitui em um ambiente de jogo, local que a imprevisibilidade, a dinâmica e as novas organizações estão presentes. Dessa maneira, faz parte da função do jogador compreender o ambiente em que ele se (...) encontra, ou seja, entender como as organizações do jogo ocorrem. De modo semelhante, o conceito chamado de “absurdo”, criado por Albert Camus, filósofo franco-argelino, assemelha-se a essa demanda do entendimento do meio em que se vive, ao exaltar a tomada de consciência. Como consequência, segundo ele, o único movimento possível, posterior à compreensão do absurdo é a revolta, ação pautada na expressão do sujeito, com vistas à justiça, à coletividade e à unidade, baseando-se em limites que não devem ser ultrapassados. A partir disso, portanto, pensa-se na possibilidade de entender o jogador enquanto um homem revoltado no jogo, buscando, dada a identificação do meio em que se está, o sucesso de sua equipe, através de suas ações. Este artigo é resultado de um processo coletivo, desencadeado entre os meses de maio e agosto de 2022, na disciplina Práticas de ensino de filosofia: programas de ensino, no segundo quadrimestre de 2022, no curso de licenciatura em filosofia da Universidade Federal do ABC (UFABC). Encerrada a disciplina e a proposta de criação de um fichário para ensino de filosofia, consideramos a relevância de transformar esse processo em um artigo, a fim de, em primeiro lugar, mostrar os fundamentos que orientaram (...) o desenvolvimento da proposta e, em segundo lugar, compartilhar com a comunidade interessada os fichários desenvolvidos, seu propósito de oferecer mais uma ferramenta para o ensino de filosofia e fomentar, inclusive, a continuidade deste trabalho que está em aberto. Using a sample of 114 leaders (described by 516 team members), we show empirically that the association between leader relational transparency and leader receptiveness to relational transparency of team members is indirect (through leader respect) and conditional on leader humility. When a transparent leader expresses humility, he/she conveys respect to team members and is perceived as more receptive to the relational transparency of employees toward him/her. The indirect association between leader relational transparency and leader receptiveness to the relational transparency of (...) team members is negative, however, when the leader is perceived as non-humble. Our paper contributes to discussion about the limits of relational transparency as an indicator of authentic leadership. We suggest that what is often described as relational transparency is no more than unidirectional transparency—from leaders to followers. We conclude that transparency (and authenticity) in leaders is relational only when it is bidirectional. (shrink)

Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

A filosofia da natureza de Aristóteles muitas vezes é apresentada como um capítulo inteiramente ultrapassado na história do pensamento: um “finalismo antiquado”, antropocêntrico, avesso à mensuração exata das condições materiais subjacentes aos fenômenos. Essa perspectiva, no entanto, é inadequada: não atenta para o papel relevante que Aristóteles atribui à matéria na explicação dos fenômenos naturais, assim como não atina com o real significado da teleologia aristotélica. Na contra-mão dessa perspectiva apressada, procuramos mostrar que, no cerne da filosofia aristotélica da natureza, (...) entendida como uma teleologia, encontra-se a idéia de que os seres naturais definem-se por uma tendência intrínseca à auto-preservação. This book uses mathematical models of language to explain why there are certain gaps in language: things that we might expect to be able to say but can't. For instance, why can we say I ran for five minutes but not *I ran to the store for five minutes? Why is five pounds of books acceptable, but *five pounds of book not acceptable? What prevents us from saying *sixty degrees of water to express the temperature of the water in a (...) swimming pool when sixty inches of water can express its depth? And why can we not say *all the ants in my kitchen are numerous? The constraints on these constructions involve concepts that are generally studied separately: aspect, plural and mass reference, measurement, and distributivity. In this book, Lucas Champollion provides a unified perspective on these domains, connects them formally within the framework of algebraic semantics and mereology, and uses this connection to transfer insights across unrelated bodies of literature and formulate a single constraint that explains each of the judgments above. The main goal of this paper is to investigate the relation between the meaning of a sentence and its truth conditions. We report on a comprehension experiment on counterfactual conditionals, based on a context in which a light is controlled by two switches. Our main finding is that the truth-conditionally equivalent clauses (i) "switch A or switch B is down" and (ii) "switch A and switch B are not both up" make different semantic contributions when embedded in a conditional antecedent. (...) Assuming compositionality, this means that (i) and (ii) differ in meaning, which implies that the meaning of a sentential clause cannot be identified with its truth conditions. We show that our data have a clear explanation in inquisitive semantics: in a conditional antecedent, (i) introduces two distinct assumptions, while (ii) introduces only one. Independently of the complications stemming from disjunctive antecedents, our results also challenge analyses of counterfactuals in terms of minimal change from the actual state of affairs: we show that such analyses cannot account for our findings, regardless of what changes are considered minimal. In this article, Lucas maintains the falseness of Mechanism - the attempt to explain minds as machines - by means of Incompleteness Theorem of Gödel. Gödel’s theorem shows that in any system consistent and adequate for simple arithmetic there are formulae which cannot be proved in the system but that human minds can recognize as true; Lucas points out in his turn that Gödel’s theorem applies to machines because a machine is the concrete instantiation of a formal system: (...) therefore, for every machine consistent and able of doing simple arithmetic, there is a formula that it can’t produce as true but that we can see to be true, and so human minds and machines have to be different. Lucas considers as well in this article some possible objections to his argument: for any Gödelian formula we could, for instance, construct a machine able to produce it or we could put the Gödelian formulae that we had proved as axioms of a further machine. However - as Lucas underlines - for every of such machines we could again formulate another Gödelian formula, the Gödelian formula of these machines, that they are not able to proof but that we can recognize as true. More general arguments, such as the possibility to escape Gödelian argument by suggesting that Gödel’s theorem applies to consistent systems while we could be inconsistent ones, are moreover refuted by Lucas by maintaining that our inconsistency corresponds to occasional malfunctioning of a machine and not to his normal inconsistency; indeed, a inconsistent machine is characterized by producing any statement, on the contrary human being are selective and not disposed to assert anything. As the author of The Liberal Conscience: Politics and Principle in a World of Religious Pluralism (2006), I outline the arguments and purposes of my book, delineating the political and philosophical problems of theocracy and describing elements of a new liberal theory able successfully to address them.

This article discusses left-libertarian justifications of basic income. The basic income policy is designed to decouple income from employment in the monetized economy by allowing the individual to access, on a regular stipulated basis, a grant that is independent of her ability and willingness to work for remuneration. This article attempts to amend an important failure with respect to the way in which the concept of real freedom has been treated in Van Parijs’ pioneering defense of the universal grant. Van (...) Parijs’ defense of basic income does not pay substantial attention to the freedom that work-lovers would gain from the opportunity to opt out of work, which the grant would facilitate if sufficiently generous. Van Parijs’ justification of basic income is incomplete in terms of the value it places on the opportunity to enjoy freedom from employment from the purview of every member of society, not only those that will, or might, decide to lead a life (partially) outside of work. The article develops the argument that such failure results from the fact that Van Parijs’ conception of freedom is centered on the importance of actual or potential preference satisfaction as opposed to non-agent-centered reasons. Davidsonian event semantics is often taken to form an unhappy marriage with compositional semantics. For example, it has been claimed to be problematic for semantic accounts of quantification Proceedings of the 16th Amsterdam Colloquium, 2007), for classical accounts of negation Semantics and contextual expression, 1989), and for intersective accounts of verbal coordination. This paper shows that none of this is the case, once we abandon the idea that the event variable is bound at sentence level, and assume instead that verbs (...) denote existential quantifiers over events. Quantificational arguments can then be given a semantic account, negation can be treated classically, and coordination can be modeled as intersection. The framework presented here is a natural choice for researchers and fieldworkers who wish to sketch a semantic analysis of a language without being forced to make commitments about the hierarchical order of arguments, the argument-adjunct distinction, the default scope of quantifiers, or the nature of negation and coordination. Role congruity theory affirms that female managers face more difficulties at work because of the incongruity between female gender and leadership role expectations. Furthermore, due to this incongruity, it is harder for female managers to perceive themselves as authentic leaders. However, followers’ attributions of prototypicality could attenuate this role incongruity and have implications on a managers’ organizational identification. Hence, we expect male managers to be more authentic and to identify more with their organizations, when compared to female managers who are (...) low in prototypicality. We hypothesized that authentic leadership dimensions mediate the relation between managers’ biological gender and their OID. However, this indirect effect is conditional of these managers' team prototypicality. For testing these hypotheses, we conducted an online experiment with 149 participants from different work sectors using a 2 × 2 between-subject design. As predicted, men scored higher on authentic leadership, and three dimensions partially mediated the effect of participants’ biological gender on OID. In the low team prototypicality condition female managers scored lower in authentic leadership and identified less with the organization, whereas in the high team prototypicality condition, no gender differences were found. This article is about our relationship with things; about the abundant material geographies that surround us and constitute the very possibility for us to be the beings that we are. More specifically, it is about the question of the possibility of an ethical encounter with things (qua things). We argue, with the science and technology studies tradition (and Latour in particular), that we are the beings that we are through our entanglements with things, we are thoroughly hybrid beings, cyborgs through (...) and through – we have never been otherwise. With Heidegger we propose that a human-centred ethics of hybrids will fail to open a space for an ethical encounter with things since all beings in the sociomaterial network – humans and non-human alike – end up circulating as objects, enframed as ‘standing reserve’, things-for-the-purposes-of the network. We suggest that what is needed is an ethos beyond ethics, or the overcoming of an ethics – which is based on the will to power – towards an ethos of letting be. We elaborate such a possibility with the help of Heidegger, in particular with reference to the work of Graham Harman and his notion of ‘tool-being’. From this we propose, very tentatively, an ethos that has as its ground a poetic dwelling with things, a way of being that lets being be (Gelassenheit). We show how such a poetic dwelling, or ethos of Gelassenheit, may constitute the impossible possibility of a very otherwise way of being with things – an ethos of a ‘community of those who have nothing in common’ as suggested by Alphonso Lingis. Liberty is forgotten: Fraternity never did engage our passions: the maintenance of Law and Order is at a discount: Natural Rights and Natural Justice are outmoded shibboleths. But Equality—there men have something to die for, kill for, agitate about, be miserable about. The demand for Equality obsesses all our political thought. We are not sure what it is—indeed, as I shall show later, we are necessarily not sure what it is—but we (...) are sure that whatever it is, we want it: and while we are prepared to look on frustration, injustice or violence with tolerance, as part of the natural order of things, we will work ourselves up into paroxysms of righteous indignation at the bare mention of Inequality. Aristotle contrasts episteme and doxa through the key notions of universal and necessary. These notions have played a central role in Aristotle’s characterization of scientific knowledge in the previous chapters of APo. They are not spelled out in APo I.33, but work as a sort of reminder that packs an adequate characterization of scientific knowledge and thereby gives a highly specified context for Aristotle’s contrast between episteme and doxa. I will try to show that this context introduces a contrast in (...) terms of explanatory claims: on the one hand, episteme covers those claims which capture explanatory connections that are universal and necessary and thereby deliver scientific understanding; on the other hand, doxa covers the explanatory attempts that fail at doing so. A strong case has been made for the role and value of mechanistic explanation in neuroscience and molecular biology. A similar demonstration in other domains of scientific investigation, however, remains an important challenge of scope for the new mechanists. This article helps answer that challenge by demonstrating one valuable role mechanisms play in phylogenetics. Using the transition/transversion rate parameter as a case example, this article argues that models embedded with mechanisms produce stronger phylogenetic tree hypotheses, as measured by maximum likelihood (...) logL values. Two important implications for the new mechanistic account of explanation are considered. (shrink)

This paper is about the phenomenon of encoding, more specifically about the encoded extension of agency. The question of code most often emerges from contemporary concerns about the way digital encoding is seen to be transforming our lives in fundamental ways, yet seems to operate ‘under the surface’ as it were. In this essay I suggest that the performative outcomes of digital encoding are best understood within a more general horizon of the phenomenon of encoding – that is to say (...) as norm- or rule-governed material enactments accepted (or taken for granted) as the necessary conditions for becoming. Encoded material enactments translate/extend agency, but never exactly. I argue that such encoded extensions are insecure, come at a cost and are performative. To illustrate this I present a brief discussion of some specific historical transitions in the encoding of human agency: from speech to writing, to mechanical writing, and finally to electronic writing. In each of these translations I aim to show that agency is translated/extended in ways that have many unexpected performative outcomes. Specifically, through a discussion of the digital encoding of writing, as reuse, I want to suggest the proposition that all agency is always borrowed (or ‘plagiarized’) – i.e. it is never originally human. As encoded beings we are never authors, we are rather more or less skilful reusers. To extend agency we have to submit to the demands of encoding and kidnap that encoding simultaneously – enabling constraints in Butler’s language. Our originality, if there is any, is in our skill at kidnapping the code and turning it into an extension of our agency, that is to say, our skill at resignification – to be original we need to be skilful ‘parasites’, as suggested by Serres. The ideal of personal autonomy enjoys considerable support in educational theory, but close analysis reveals serious problems with its core analytical and psychological components. The core conception of autonomy authorizes individuals to employ their imaginations in troubling and unhealthy ways that clash with sound ideals of moral character. Lucas Swaine argues in this essay that this gives grounds to deny that the core conception of autonomy should be promoted in democratic education. What is more, according to Swaine, young citizens (...) appear to have no right to be educated, in public schools, for the purpose of becoming autonomous individuals of the kind he describes and criticizes in this account. Rejecting the Cut rule has been proposed as a strategy to avoid both the usual semantic paradoxes and the so-called v-Curry paradox. In this paper we consider if a Cut-free theory is capable of accurately representing its own notion of validity. We claim that the standard rules governing the validity predicate are too weak for this purpose and we show that although it is possible to strengthen these rules, the most obvious way of doing so brings with it a serious (...) problem: an internalized version of Cut can be proved for a Curry-like sentence. We also evaluate a number of possible ways of escaping this difficulty. (shrink)

Throughout the history of Christian spirituality, it has been held that it is impossible to adequately name God. The Neoplatonic readings of Plato's Parmenides, particularly by Plotinus and Proclus, decisively influenced the course of Western philosophy and theology. From a comparison of the notion of God in Dionysius the Pseudo-Areopagite, Epistle III, and in Martin Heidegger's text "Der letzte Gott," I show that there is a common thread, based in the Pauline idea of kenösis.

Esse trabalho discute o quanto a cultura dos jogos digitais acaba mantendo-se enquanto um campo que, embora aparentemente acessível e democrático, se centra em uma experiência voltada para as vivências de homens, heterossexuais, brancos e cissexuais. Utilizando-se de conceitos provenientes da teoria crítica (principalmente da Escola de Frankfurt), ponderamos o quanto a compreensão clássica de “círculo mágico” acaba por decorrer na manutenção de uma compreensão de “diversão” calcada em uma compreensão de “anti-política”. Dessa maneira, os jogos digitais mainstream acabam mantendo (...) culturas e comunidades baseadas manutenção do status quo identitário e de uma ideologia neoliberal de mercado. (shrink)

Whatever good or ill it did to Guy Fawkes, his resuscitation at the hands of Bernard Williams has, by any utilitarian reckoning, been a Good Thing. A casual glance at the literature that has accumulated over the past thirty five years leaves no doubt that the topic has been reduplicated many times over, to the great enjoyment of undergraduates, who have been able to write science fiction under the guise of essays in the Philosophy of Mind, and of dons, who (...) in an age of cvs and Assessments, have been able to notch up page after page of counter-replies to replies to rebuttals of previous papers, not to mention an often welcome tally of references in the citation index. But the actual arguments adduced by Williams can be turned to support a much more traditional view of the self, as a necessarily unique agent whose individuality is established by his capacity for autonomous action. Two questions are distinguished: how to program a machine so that it behaves in a manner that would lead us to ascribe consciousness to it; and what is involved in saying that something is conscious. The distinction can be seen in cases where anaesthetics have failed to work on patients temporarily paralysed.

John Stuart Mill’s Utilitarianism engages our interest and sympathy because it is flawed. It reflects the crisis in Mill’s life, when he lost his faith. He had been brought up by his father in the straitest tenets of utilitarianism, but had had nervous breakdown in early adult life from emotional ill-nourishment. Utilitarianism might work as a guide for the well-governing of India by James Mill and his colleagues, but gave little sustenance to the aspiring spirit of the Romantic Movement. It (...) treats people as units, not individuals. It takes no account of the “projects” that people pursue, as Bernard Williams.. (shrink)

The stock of natural law has risen in recent years. It is partly due to growing dissatisfaction with the elucidations offered by the legal positivists, and partly because sceptical arguments have lost their edge. In the heyday of logical positivism it was easy to say ``I don't understand what you mean by `right' . . .'' and break off discussion without more ado; but, as the bounds of unintelligibility increased and came to encompass almost the whole of human knowledge, an (...) inability to understand became not so much a boast as a confession. Many people may still be unclear about the metaphysical foundations of the moral sciences; but we are disinclined to doubt that they are serious disciplines, or to think that they need to be, or even could be, reconstructed without any moral element. Moreover, the events of this century have begun to penetrate the academic consciousness. Having witnessed the terrible tyrannies of the Nazis, the Communists and the Third World, we find it difficult to divorce our thinking about law from our thinking about morals. Although 'duty' is still an unfashionable word, people are constantly talking about the rights that are being denied them and the wrongs being inflicted on them. And these rights claimed and wrongs resented are grounded not on some existing legal enactment or a one-time social contract, but on the nature of man and the nature of the state, and are therefore, although very different from their mediaeval articulation, arguments of natural law. And whereas mostly in academic life it is appropriate to adopt a prudential strategy, and not say anything that might be wrong, I owe it to you on this occasion to play a (...) maximax strategy, to speak out and say what I really think, being willing to run the risk of being wrong in order not to forgo the chance of actually being right in an area of the philosophy of science which must, I think for ever, be largely a matter of metaphysical speculation. According to the dual inheritance theory, cultural learning in our species is a biased and highly efficient process of transmitting cultural traits. Here we define a model of cultural learning where social learning is integrated as a complementary element that facilitates the discovery of a specific behavior by an apprentice, and not as a mechanism that works in opposition to individual learning. In that context, we propose that the emergence of the ability to approve or disapprove of offspring behavior, orienting (...) their learning, transformed primate social learning into a cultural transmission system, like that which characterizes our species. Assessor teaching facilitates the replication and/or reconstruction of behaviors that are difficult to imitate and helps to determine which behaviors should be imitated. We also explore the form in which assessor teaching has conditioned the evolution of our abilities to develop cultures in the hominin line, converting us into individuals equipped with what we call a suadens psychology. Our main point is to defend the hypothesis that suadens psychology determines the stability and dynamics that affect the trajectories of many cultural characters. We compare our proposal with other theories about cultural evolution, specifically with dual inheritance theory and cultural attraction theory. (shrink)

I discuss Aristotle's anomalous terminology in Physics A.1 (involving "universals" and "particulars") and its coherence with Aristotle's notion of scientific demonstration.

Through a qualitative approach, we explore the perspective of 72 CEOs of companies operating in Portugal about the definition of corporate sustainability and its facilitators, and obtain four main findings. First, most CEOs equate CS with the company’s continuity/viability. Second, the relevance ascribed to different stakeholders differs considerably: while more than 50 % of CEOs cited shareholders/profits, and more than 40 % mentioned the natural environment and employees, very few mentioned customers, society, suppliers, the State, or competitors. Third, the management (...) practices considered as most important to develop CS are the organization’s strategic alignment with a long-term orientation, and developing and energizing people within a positive organizational climate characterized by trust and ethics. Fourth, the leadership characteristics and behaviors considered as most important to foster CS are scrutinizing the future and leading people through a mobilizing vision; energizing and developing employees; and leading by example. While the whole picture is largely consistent with the “sustainable strategic management” approach suggested by Stead and Stead and with recent CS integrative approaches, the great majority of CEOs who participate in the study have not embraced such integrative and coevolutive perspectives.
